A Letter of Response From Congressman Tierney
This letter is a response to my letter asking if Congressman Tierney could make a statement regarding the alleged hate crime involving the victim named Justin Goodwin that occurred over Easter weekend in April:
Thank you Congressman Tierney for your response, and thank you for your support of the obviously needed hate crimes laws. When we can punish those who wish to harm others for hate's sake in a degree that suits the crime perhaps people will be less likely to follow through with such wickedness.

I share your concern with the beating of Justin Goodwin, and I appreciate your bringing the related article in the Gloucester Daily Times to my attention. Be assured I will continue to closely monitor this case, and will keep your comments in mind as I do so. In the meantime, you may be interested to know that, on April 29, 2009, I voted in favor of H.R. 1913, the Local Law Enforcement Hate Crimes Prevention Act of 2009, when it was considered by the U.S. House of Representatives. This bill now moves on to the U.S. Senate for consideration, and I will continue to press for its passage and work to advance our shared priorities.

GOVERNOR PATRICK, MAYOR MENINO ANNOUNCE $100 MILLION+ FOR BOSTON BUS SERVICE
Two-stage bus rapid transit initiative will support economic growth, improve New England’s busiest bus corridor and connect key Boston neighborhoods
BOSTON – Monday, May 04, 2009 – As part of his Massachusetts Recovery Plan to secure the state’s economic future, Governor Deval Patrick joined Boston Mayor Thomas Menino and Transportation Secretary James Aloisi today to announce federal stimulus funding to improve bus service along New England’s busiest bus corridor and in neighborhoods currently not served by rapid transit.
The two-stage bus rapid transit project will provide a direct Silver Line connection from Dudley Station to South Station in Boston this fall, and replace an existing heavily-used bus route from Mattapan to Ruggles Station with rapid transit bus service that will provide faster, more reliable service to tens of thousands of trips a day. The announcement comes after the recent announcement of the Patrick Administration “flexed” highway federal recovery funding to build a state-of-the-art regional transit center in Greenfield.
“With smart, strategic use of federal recovery funds we can bring rapid transit to some of Boston’s busiest bus routes, connecting key neighborhoods and delivering reliable service for tens of thousands of commuters who rely on the MBTA," said Governor Patrick.
“Improving and expanding our transportation infrastructure is critically important to our economy,” said Lieutenant Governor Timothy P. Murray. “Projects like these will not only benefit commuters but also the businesses that count on reliable service for their employees.”
"I am proud to support this project because it will revitalize one of Boston's most important corridors and get shovels in the ground and people back to work," said Mayor Thomas Menino. "My administration is committed to helping the MBTA connect our neighborhoods more directly to Boston's financial district and creating more opportunities for our residents."
In the first stage of the initiative, the Executive Office of Transportation will use federal recovery funds to improve Silver Line service with a direct connection from Dudley Station to South Station, including the addition of dedicated bus lanes on Essex Street and a new, state-of-the-art street-level terminal at South Station with lighting, seating, heaters, and countdown signals to provide additional comfort to riders.
Concurrently, a mix of transit and highway federal recovery funds will also be used to enhance service along New England’s busiest bus corridor in the neighborhoods of Roxbury, Mattapan and Dorchester. The existing Route 28 bus line will be transformed into first-class bus rapid transit service from Mattapan Station on the Red Line to Ruggles Station on the Orange Line with a direct connection to the Silver Line. Additional station facilities will be located along Blue Hill Avenue in Mattapan and Dorchester, as well as along Warren Street in Roxbury.
This new state-of-the-art bus rapid transit line will also feature dedicated bus lanes, longer “articulated” diesel-hybrid buses, and innovative design and technology features like “queue jumping” (allowing buses to bypass lines at traffic signals) and traffic signal priority to speed up service and dramatically improve reliability. In addition, federal transit stimulus funds will be used to invest in several upgrades to the Dudley Square Station.
The two-stage bus rapid transit project is will cost approximately $114 million, but it could change as the specific design is more refined. Of the projected $114 million, $76 million is for construction and the remainder is for planning, engineering, right-of-way acquisition, and other administrative costs.
“The development of safe and efficient public transportation is a job-creator and an energy-saver,” said Senator Edward Kennedy. “This federal investment will mean increased access to downtown and faster commutes for thousands of Massachusetts workers and residents. I commend Governor Patrick for his efforts to ensure that public transportation in Boston and throughout Massachusetts is first-rate.”
“This means jobs and economic development in communities that need a boost,” said Senator John Kerry. “Faster, cleaner buses mean fewer harmful emissions and a better quality of life for the thousands of Boston residents who rely on public transportation for a safe, quick commute.”

Cambridge Mayor gives GLBT Commissioner Mason Key to City and Bon Voyage!
On April 26, 2009 GLBT commissioner Christopher Mason was presented the key to the city of Cambridge by mayor Denise Simmons as well as given a proper send off for his journey through all 48 contiguous states this summer as part of his good will tour project, drivingequality.com. Mason plans on documenting his experiences along the way and creating a full length film once his travels conclude while juggling his courses at Tufts University. His trip is planned to begin on May 10 and will take him the entire summer to complete, ending only days before he returns to school.
Feel free to leave words of encouragement here, Commissioner Mason and I are friends and he will undoubtedly read your words for himself.
Have a safe and prosperous trip Chris, I know we will miss you and look forward to your reports along the way as well as your triumphant return!
"Bathroom Bill" Logic Bans Gays From Bathrooms in Kentucky Schools
Several states including Massachusetts have been urged by "family" groups like Massachusetts Family Institute to ignore the needs of transgendered people to have equal protection under the law by bringing up the point that they are obvious criminals that only want to use the same bathroom as women and children to prey on them.
How denying the use of a bathroom more suitable for someone's new gender identity would prevent predators from going into a bathroom doesn't seem to be concluded, but what the heck, right?
Now we have this story:
Kentucky Equality Federation received reports that a Franklin County High official allegedly sent an email to teachers instructing them not to allow homosexuals to leave class to use the restroom.
The email was allegedly sent after two female classmates were caught kissing in the public restroom.
In response, 15 students protested outside the school today.
"My daughter was involved in a protest at Franklin County High School today for their right to use the restroom," stated Michelle Sexton.
"I have been in contact with one of the parents of the children involved in the protest and we support their constitutional right to assemble peacefully," stated Kentucky Equality Federation President Jordan Palmer. "We call on the media to investigate this issue further and shed light on the discrimination gays and lesbians face throughout the Commonwealth. Kentucky Equality Federation will also be contacting the other parents of the children involved in today's protest."
Though Superintendent Harrie Buecker stated steps are being taken to address the students' concerns, Kentucky Equality Federation is concerned they will not be addressed properly. Though not directly connected, Kentucky Equality Federation has received similar complaints in Casey, Pulaski, and Powell counties about unfair treatment of gay and lesbian students and teachers.
"I'd like to know what level this mentality, that gay and lesbian students should not be treated equally is coming from. An incident in one county could be called an isolated incident, but we now have similar reports in three other Kentucky Counties," stated Kentucky Equality Federation Managing Director Laura Reed.
Kentucky Equality Federation will continue its own investigation and assist parents or students in filing any necessary complaints with Kentucky officials.
Palmer added that assembling together in a peaceful manner is the most basic right granted by the Kentucky Constitution, and that Kentucky Equality Federation had contacted the Office of Helen W. Mountjoy, Kentucky's Secretary of Education for assistance in resolving the issues.

What Unites Us? (Op-Ed)
Our nation is known as the "United States of America", but what is it that unites us? This question came to my mind as I was reading the Voter Rights Act where there is a portion that addresses voters who speak other languages:
Multilingual balloting
The Act requires municipalities that receive requests for ballots in other languages to comply with the request. Rep. Dana Rohrabacher of California said of the Act, "What unites us? It's our language, the English language," and that the Act is "hurting America by making it easier not to learn English."
Does the English language unite us as a nation? If so how does that effect citizens who do not speak English?
When thinking through this line of logic I am reminded of a joke heard in France a while ago at our nation's expense. It goes something like this:
"What do you call someone who speaks multiple languages?"
"Multilingual"
"What do you call someone who speaks two languages?
"Bilingual"
"what do you call someone who speaks only one language?"
"American"
Only in America are the bigoted ideals of the ignorant so supported they seem celebrated. Allow me to share this painful example: The NH "Pants man"
Allow me to share my opinion on what unites us. In a country to rich in diversity it is no particular trait that unites us, but rather the acceptance of that diversity without the need to compromise your own views while standing together in defense of that liberty. Indeed, liberty is our most valuable heirloom and is what "unites" America. The terms of that liberty is defined in the Constitution which derives it's power by the free will of the people to follow it. No religion, language, ethnicity, or other discerning features in society should be used to imply one group has more authority or authenticity than another opposing view unless a compelling interest can be found.

Maine Senate Votes in Favor of Gay Marriage

Petitions are a wonderful thing provided that the will of the majority is rightful. Denying other equal citizens there rights by voting them away is unconstitutional. That aside I suspect the process will be riddled with signature fraud which I intend on coaching the leadership in Maine about what they can do and what to expect.
If they go into this process with their eyes open they may be able to prevent the petition from gaining enough signatures. Having a community watch program that patrols for petition signature gatherers is a good idea. This allows us to have someone watching the opposition to ensure no signatures get stolen like they were in Massachusetts in 2005. We need to start a education campaign as well so that citizens are more informed as to the deceptions being used against them.
All said from what I saw Mainers are pretty savvy. I'm not sure they will be as easily fooled as people in the past. I'm sure that if the law allows Tom Lang and KnowThyNeighbor.org will give Mainers something to talk about if they go forward with such a petition.
For those who have been following this (Annie) the House vote is expected Tuesday.
AUGUSTA, Maine -- The Maine Senate gave two nods of approval to a bill to legalize gay marriage after extended and emotional debate Thursday.
The measure now moves to the House of Representatives for consideration next week, and then back to the Senate for a third, and perhaps final, vote.
In initial voting, the Senate voted 20-15 to give its preliminary approval. Next, an amendment to require a statewide referendum on the matter was rejected, 22-13. Then the Senate registered its support for the original measure again, this time by 21-14.
Gay-marriage supporters were elated. But one organizer, Maggie Ricker of Chelsea, echoed a number of lawmakers in saying she expects opponents of same-sex marriage to use a petition drive to force a people's veto referendum even if the bill wins enactment in the Legislature.
"We've been planning for it already," Ms. Ricker said. "And it's their right."

POLL SHOWS SUPPORT FOR GAY MARRIAGE

For the first time in a nationwide survey, more Americans say they support gay marriage (49%) than oppose it (46%), according to the latest Washington Post/ABC poll.
That 49% supporting gay marriage, in fact, is a significant jump from 2004, when the Post/ABC poll found just 32% in favor.
This surge within the past month suggests that any backlash against the recent moves across the country to legalize gay marriage has yet to emerge.
Also in the new survey, a majority of Americans (53%) believe that their state should recognize gay marriages from other states.
Other recent polls have shown a similar increase in support for gay unions nationwide. The New York Times/CBS News poll released this week showed 42% of Americans supporting gay marriage -- the highest number ever recorded in that poll. This week's Quinnipiac poll, which found a majority (55%) against gay marriage, also showed 57% of Americans support civil unions.

Obama Administration Auto Restructuring Initiative
Chrysler-Fiat Alliance
On March 30, 2009, President Obama laid out a framework for Chrysler to achieve viability by partnering with the international car company Fiat. After a month of close engagement with the President’s Auto Task Force, Chrysler, Fiat and their key stakeholders have made unprecedented sacrifices and executed an agreement that positions Chrysler for a viable future.
Chrysler has not only been an icon of America’s auto industry and a source of pride for generations of American workers; it has also been responsible for helping build our middle class, giving countless Americans the chance to provide for their families, send their kids to college, and save for a secure retirement. As a result of the sacrifices by key stakeholders and a substantial commitment of U.S. government resources, Chrysler has an opportunity to thrive as a long-term viable 21st century company. To execute this agreement, Chrysler will use Section 363 of the bankruptcy code to clear away the remaining impediments to its successful re-launch.
The Chrysler Fiat Alliance – Shared Sacrifice
· The alliance will retain Chrysler’s existing factory footprint and continue producing Chrysler cars in U.S. factories. The alliance will create the sixth-largest global automaker, spreading R&D and design development costs over higher volumes, making it more competitive in an increasingly global and consolidating industry.
· Fiat is contributing billions of dollars in advanced technology and intellectual property, and offering Chrysler access to a global distribution network. Fiat’s technology will allow Chrysler to build new fuel efficient cars and engines in U.S. factories.
· The UAW has made important concessions on wages, benefits, and retiree health care that, while difficult, will help save jobs for active employees, pensions and health care for retirees and make Chrysler more competitive.
· Chrysler’s largest secured creditors have agreed to exchange their portion of the Company’s $6.9 billion secured claim for their pro-rata share of $2 billion in cash at closing. The Bankruptcy Court process will be used to confirm this treatment on those lenders that failed to accept the offer that was accepted by a majority of the lenders.
· Daimler, Chrysler’s current minority shareholder, has agreed to waive its share of Chrysler’s $2 billion of second lien debt, give up its 19% equity interest in Chrysler’s ultimate parent, and settle its guaranty obligation to the PBGC by agreeing to pay $600 million to Chrysler’s pension funds.
· Cerberus has agreed to waive its share of Chrysler’s $2 billion of second lien debt and forfeit its entire equity stake in Chrysler. Cerberus has also agreed to transfer its ownership of the Chrysler headquarters in Auburn Hills, Michigan to the new Chrysler alliance. Lastly, Cerberus will contribute a claim it had against Daimler to assist in the Daimler settlement with the PBGC.
Details on the Chrysler Fiat Alliance:
· Fiat will contribute a free license to use all of its intellectual property and “know how” to capitalize Chrysler in exchange for 20% of the equity of the reorganized Chrysler. Fiat will have the right to select three directors of Chrysler once reorganized. In addition, Fiat will have the right to earn up to 15% in additional equity in three tranches of 5% – each in exchange for meeting performance metrics, including introducing a vehicle produced at a Chrysler factory in the U.S. that performs at 40 mpg; providing Chrysler with a distribution network in numerous foreign jurisdictions; and manufacturing state-of-the art, next generation engines at a U.S Chrysler facility.
· The newly reorganized Chrysler will purchase substantially all of the assets of the old Chrysler out of a chapter 11 bankruptcy case in exchange for a $2 billion payment to its secured lenders.
· This new Chrysler will establish an independent trust (VEBA) that will provide health care benefits for Chrysler’s retirees. · Working capital: The U.S. government is prepared to provide approximately $3.3 billion in debtor in possession financing to support Chrysler through an expedited chapter 11 proceeding.
· Loan to the New Chrysler: Upon closing, the U.S. government is prepared to loan approximately $4.7 billion to New Chrysler, in the form of a term loan with $2.1 billion due in 30 months and the balance 50% due on the 7th anniversary and 50% due on the 8th anniversary of the loan. The interest will be an appropriate combination of cash and payment-in-kind. There is also an additional note of $288 million which is a fee for making these loans. The loans will be secured by a first priority lien on all of Chrysler’s assets.
Canadian Government Participation:
· The governments of Canada and Ontario will participate alongside the U.S. Treasury in lending money to Chrysler and New Chrysler based on a 3:1 formula using Canadian currency. The amount lent by the Canadians is incremental to the funding referenced above.
Viable Financing Solution:
· Chrysler will enter into an agreement with GMAC to provide dealer and customer financing. This agreement will continue once Chrysler has emerged from bankruptcy. Chrysler Financial has agreed to uphold and cooperate in the transition of its current agreements with dealers to GMAC. The U.S. Government is supporting the automotive restructuring initiative by promoting the availability of credit financing for dealers and customers, including liquidity and capitalization that would be available to GMAC, and by providing the capitalization that GMAC requires to support the Chrysler business.
Warranties:
· Chrysler will continue to honor consumer warranties. Yesterday, the U.S. Treasury made available the Warranty Support Program to Chrysler and $280 million was funded to a special vehicle available to provide a backstop on the orderly payment of warranties for cars sold during this restructuring period.
Executing the Chrysler-Fiat Alliance
While many stakeholders made sacrifices and worked constructively in this process, some did not. In particular, a group of investment firms and hedge funds failed to accept reasonable offers to settle on their debt. In order to effectuate this alliance without rewarding those who refused to sacrifice, the U.S. government will stand behind Chrysler’s efforts to use our bankruptcy code to clear away remaining obligations and emerge stronger and more competitive.
During this process, Chrysler will continue operating in the ordinary course. From an operating perspective, the day after the filing will not be materially different from the day before the filing. The following parties will be treated as described below:
· Employees: Employees will get paid in the ordinary course, including salary, wages and ordinary benefits. Workers compensation claims will continue to be paid by Chrysler’s insurers. Assuming the sale moves forward as expected, Pension Plan and VEBA funding will be transferred to the purchaser.
· Suppliers: Chrysler will seek authority at its “first day” hearing to continue to pay suppliers in the ordinary course. In addition, the U.S. Treasury’s Supplier Support Program will continue to operate, and Chrysler suppliers benefiting from the program will continue to receive that benefit.
· Dealers: Chrysler will seek authority at its “first day” hearing to honor its customer warranties in the ordinary course. Moreover, Chrysler will seek to continue to honor its dealer incentives for those dealers who are expected to continue to be part of Chrysler’s distribution network going forward. There are some dealers that Chrysler has identified and certain other dealers identified by GMAC as being risky credits that will not continue with Chrysler. It is expected that the terminated dealers will wind down their operations over time and in an orderly manner.
· UAW: The modified labor agreement reached between the UAW and Chrysler will be operative.
· Creditors: A majority of the Senior Secured Lenders now support the transaction with Chrysler.
On March 30, 2009, President Obama laid out a framework for Chrysler to achieve viability by partnering with the international car company Fiat. After a month of close engagement with the President’s Auto Task Force, Chrysler, Fiat and their key stakeholders have made unprecedented sacrifices and executed an agreement that positions Chrysler for a viable future.
Chrysler has not only been an icon of America’s auto industry and a source of pride for generations of American workers; it has also been responsible for helping build our middle class, giving countless Americans the chance to provide for their families, send their kids to college, and save for a secure retirement. As a result of the sacrifices by key stakeholders and a substantial commitment of U.S. government resources, Chrysler has an opportunity to thrive as a long-term viable 21st century company. To execute this agreement, Chrysler will use Section 363 of the bankruptcy code to clear away the remaining impediments to its successful re-launch.
The Chrysler Fiat Alliance – Shared Sacrifice
· The alliance will retain Chrysler’s existing factory footprint and continue producing Chrysler cars in U.S. factories. The alliance will create the sixth-largest global automaker, spreading R&D and design development costs over higher volumes, making it more competitive in an increasingly global and consolidating industry.
· Fiat is contributing billions of dollars in advanced technology and intellectual property, and offering Chrysler access to a global distribution network. Fiat’s technology will allow Chrysler to build new fuel efficient cars and engines in U.S. factories.
· The UAW has made important concessions on wages, benefits, and retiree health care that, while difficult, will help save jobs for active employees, pensions and health care for retirees and make Chrysler more competitive.
· Chrysler’s largest secured creditors have agreed to exchange their portion of the Company’s $6.9 billion secured claim for their pro-rata share of $2 billion in cash at closing. The Bankruptcy Court process will be used to confirm this treatment on those lenders that failed to accept the offer that was accepted by a majority of the lenders.
· Daimler, Chrysler’s current minority shareholder, has agreed to waive its share of Chrysler’s $2 billion of second lien debt, give up its 19% equity interest in Chrysler’s ultimate parent, and settle its guaranty obligation to the PBGC by agreeing to pay $600 million to Chrysler’s pension funds.
· Cerberus has agreed to waive its share of Chrysler’s $2 billion of second lien debt and forfeit its entire equity stake in Chrysler. Cerberus has also agreed to transfer its ownership of the Chrysler headquarters in Auburn Hills, Michigan to the new Chrysler alliance. Lastly, Cerberus will contribute a claim it had against Daimler to assist in the Daimler settlement with the PBGC.
Details on the Chrysler Fiat Alliance:
· Fiat will contribute a free license to use all of its intellectual property and “know how” to capitalize Chrysler in exchange for 20% of the equity of the reorganized Chrysler. Fiat will have the right to select three directors of Chrysler once reorganized. In addition, Fiat will have the right to earn up to 15% in additional equity in three tranches of 5% – each in exchange for meeting performance metrics, including introducing a vehicle produced at a Chrysler factory in the U.S. that performs at 40 mpg; providing Chrysler with a distribution network in numerous foreign jurisdictions; and manufacturing state-of-the art, next generation engines at a U.S Chrysler facility.
· The newly reorganized Chrysler will purchase substantially all of the assets of the old Chrysler out of a chapter 11 bankruptcy case in exchange for a $2 billion payment to its secured lenders.
· This new Chrysler will establish an independent trust (VEBA) that will provide health care benefits for Chrysler’s retirees. Massachusetts Family Institute Resorts to Deceptions... Again!
So where is the desecration? I don't know either, but it sounds scary huh? This graveyard has a huge area to walk around the graves without disturbing them which we were careful to use, but I suppose the mere thought of gays on hallowed ground was what Kris Mineau of Massachusetts Family Institute was referring to.
I think Kris was angry that we came right to the window and in his embarrassment was looking to lash out and this was the best he could come up with. Were there any truth to desecrating graves the police would have arrested me at the very least, since I was a primary organizer. This is not the first time Kris has had trouble with telling the truth as shown in this video. I have a question for you Kris; what are you doing with a video taken by a MassResistance.com member? Finally the denial can no longer be convincing to anyone. The obvious truth is that you do in fact work together with an SPLC certified hate group.

"The New Hampshire Senate voted, 13-11, today to allow adult same-sex couples to marry, approving an amended version of a House-passed bill after a vote to kill the legislation altogether failed by the same margin.
The bill passed by the Senate recognizes a distinction between civil and religious marriages and allows religious denominations to decide whether they will conduct religious marriages for gay or lesbian couples. Civil marriages would be available to both heterosexual and same-sex couples under the law. “This bill recognizes the sanctity of religious marriage and the diversity of religious beliefs about marriage while still providing equal access to civil marriage to all New Hampshire citizens,” said Sen. Maggie Hassan, an Exeter Democrat.
The legislation cannot advance to the governor for his signature or veto unless both houses approve the same version. "
So, it's back to House, where a similar bill passed with a razor thin margin.

Some Good News From New Jersey
As of yet, I have no further information about when New Jersey's legislature will take up a marriage equality bill, except that it is likely that it will be this year.
But we have some good news to report:
TRENTON — A new poll finds New Jersey voters support allowing gay couples to marry.
The Quinnipiac University Poll results are similar to a Monmouth University poll in February.
This poll finds 49 percent supporting gay marriage; 43 percent are opposed.
Women and whites tend to favor a gay marriage law, while blacks, men and those who attend religious services weekly are more likely to oppose it.
New Jersey lawmakers are likely to consider a gay marriage bill later this year. The state now offers same-sex couples civil unions, which offer legal benefits but not the title of marriage.
The poll of 2,222 registered New Jersey voters was conducted from April 14-20 and has a sampling error margin of plus or minus 2.1 percentage points.
I'm feeling very optimistic, especially in light of this:
AUGUSTA (NEWS CENTER) -- Recent polls have shown Maine voters almost evenly divided over the same sex marriage issue. That is not the case with the judiciary committee, as legislators endorsed the same sex marriage bill by a wide margin. [11-2]

Iowa Gay Marriages Begin

Same-sex couples are applying for marriage licenses in Iowa today, after the Supreme Court's historic decision to legalize gay marriage.
Watch: Recorders Begin Issuing Same-Sex Licences
At least 15 couples were waiting in line at the Polk County Administration Building in downtown Des Moines along with supporters and members of the local and national media.
Some were in line at the facility as early as 6:00 a.m.
Same-sex weddings could take place Monday if couples can secure waivers from judges that let them bypass Iowa's three-day waiting period. KCCI News is following one couple attempting to do just that. We'll hear their story later today on KCCI.com and NewsChannel8.
At least one pro-gay marriage group is counting on those waivers and has announced its members will hand out bouquets to newly married couples in five of Iowa's larger cities.
For same-sex couples this is a day they waiting for, some want to celebrate what they call a victory by being among the first in the state to get a license.
Iowa Family Policy Center President Chuck Hurley is also at the County Administration Building. He is delivering petitions urging the County Recorder not to honor same-sex marriage applications.
Iowa becomes the third state offering same-sex marriage behind Massachusetts and Connecticut. Vermont has passed a law that will take effect in September.
Some details:
Marriage requirements in Iowa remain the same, with the exception that the ban on same-sex marriage has been eliminated:
Two people, over 18.
Not already legally married.
Not closely related.
Legally competent to enter into a civil contract.

While to some the future of HB 444 for Civil Unions looks bleak, don’t tell that to the thousands of equality activists on the ground in Hawai’i. Technically there still is time to pull HB 444 from the Senate Judiciary Committee (that is deadlocked at 3-3) and get the bill on the Senate floor. It’s already passed the House 33-17!
Once HB 444 is on the Senate floor, 18 of the 25 senators have pledged to vote for it. BUT getting it on the floor has been difficult. It takes 9 votes to get it out of a deadlocked committee. In a brave move on March 25th, Sen. Gary Hooser tried to get the 9 votes. He got only 5 in addition to his own. The honor roll of bravery for equality: Sens. Les Ihara, Michelle Kidani, Rosalyn Baker, Suzanne Chun Oakland, Carol Fukunaga and Gary Hooser.

Iowa Senator Makes Defiant Act Against Gay Marriage
One Republican lawmaker's bluff and bluster is being challenged and a social conservative group says it will legally back up opponents of the decision.
Yesterday, Ed Fallon, a former legislator from Des Moines, filed a formal ethics complaint against Senator Merlin Bartz, a Republican from Grafton who has urged county recorders to defy the state Supreme Court's April 3 decision that legalized gay marriage, reports the Des Moines Register.
Fallon claims Bartz has violated his oath of office by urging county recorders to break the law.
“It's really important that state lawmakers respect their oath of office and we have really serious questions about whether that's happening in this case,” he said.

On Tuesday, Bartz attempted to give shelter to county recorders by introducing an amendment that would allow county recorders who objected to gay marriage to refuse to issue a marriage license to gay and lesbian couples on “conscientious” grounds. Senate leaders ruled the issue out of order and it was not debated.
Bartz is also supporting a petition drive by the Iowa Family Policy Center, the state's primary anti-gay marriage group, that urges country recorders to ignore the court's ruling.
Fallon's complaint questions if Republican legislative staffers were used to develop a website dedicated to promoting the petition.
State Attorney General Tom Miller has repeatedly warned country recorders that they cannot refuse to issue a marriage license to gay and lesbian couples. A position Bartz criticized in a press release titled Bartz To AG: Stop The Hypocrisy.
